Builder wins £7500 compensation in back injury case
Robert Walker was employed by his construction firm to lay a base of concrete at a site, when he was called upon to lift a very heavy object and badly damaged his back. Mr Walker contacted personal injury law firm, Rapid Solicitors, to make a claim for compensation. He said: “We laid down the metal wiring and poured the concrete in. We used a mechanical metal beam to level off the concrete. When that was done, we had to lift the beam by hand and move it. It was so heavy that four of us were doing it. The guy at my end of the beam slipped and dropped it. I took the weight of the beam and suffered a slipped disc and a trapped nerve. I made a claim because I was off work for a long time and lost a lot of money.” A Solicitor at Rapid said: “This was a straightforward case, really, in terms of proving negligence. When it came to negotiating the actual compensation amount for our Client, we had to fight for every penny. We collected the hospital surgery reports, accident book, first-aider report and witness statements, to establish the facts of the accident. We took that evidence to the Defendants and persuaded them to admit liability. We alleged a breach of Manual Handling Regulations because the Defendants had permitted our Client to lift heavy objects without a safe system of work. We then engaged an orthopaedic surgeon to examine him and write an assessment of his injuries and how those injuries could be expected to progress.
